10 Golden Rules for buying property
in Turkey

In Turkey everything revolves
around the TAPU
-
The
purchase and sale of property in Turkey are the responsibility of the land
registry. The official transaction takes place there, not in the preceding
negotiations with agents, developers or private vendors.

This
means that agreements and contracts previously concluded are not a legally
valid transfer of the TAPU.

You
should therefore not pay more than the usual 10% deposit until the transfer
of the TAPU has taken place.

Demand a watertight TAPU from the vendor for existing properties and get a
lawyer to check whether the entry is correct and free of debts and charges.
Engage a lawyer, not a notary, for this purpose.

A
further prerequisite for the grant of a TAPU entry is a permit from the
central military authorities in Izmir. As a rule it takes three months to
gain this permit.

The
transaction can take place at the TAPU office when all these requirements
have been fulfilled. Here the law requires the presence of an official and
both vendor and purchaser.

The
purchase agreement and the land register entry are drawn up in Turkish. Only
translations attested by a certified interpreter are valid in law.

Until
July 2003 foreigners were only allowed to buy property within the boundaries
of villages and towns up to a maximum area of 20,000 m2. This regulation no
longer applies. Nor is the limitation in force outside communal boundaries.

Foreigners are not permitted to buy property near to closed military zones.

Holiday homes may be let. Income tax, currently 24%, has to be paid on the
profits.
